Terms of Use
This English version is provided for convenience. In case of any discrepancy between the English and Russian versions, the Russian version shall prevail.
1. General provisions
1.1.These Terms of Use (the "Terms") govern the relationship between Urban Media LLP (TOO «Urban Media»), BIN 050840004119 (the "Administration"), and any person using the website https://urbanmedia.kz (the "User").
1.2.By starting to use the Website (viewing pages, downloading materials, completing the enquiry form), the User confirms that they have read the Terms and the Privacy Policy and accept them in full. If the User does not agree with the Terms, they must stop using the Website.
1.3.The Administration may amend the Terms without special notice. A new version takes effect when published on the Website. Continued use of the Website after publication of changes means acceptance of them.
2. Definitions
2.1.Website means the set of web pages, texts, images, program code and other materials published at https://urbanmedia.kz.
2.2.Administration means Urban Media LLP (TOO «Urban Media»), the owner of the Website.
2.3.User means any individual, including one acting on behalf of a legal entity, who has accessed the Website.
2.4.Content means texts, photographs, videos, graphics, logos, presentations, case descriptions and other materials published on the Website.
3. Subject of the Terms
3.1.The Administration provides the User with free access to the Website containing information about the Company, its services, clients, vacancies and blog posts, and the ability to download the Company presentation and send an enquiry via the enquiry form.
3.2.Information on the Website is for reference only and is not a public offer within the meaning of Article 395 of the Civil Code of the Republic of Kazakhstan. Terms of service, deadlines and prices are set by separate contracts between the Administration and the client.
3.3.The Website is provided "as is". The Administration may change the structure, design and Content of the Website at any time, and suspend or discontinue its operation.
4. Rights and obligations of the parties
4.1.The User may:
- view the Website and its Content for personal non-commercial purposes;
- download the Company presentation to learn about its services;
- send enquiries and CVs to the Administration in the ways indicated on the Website.
4.2.The User undertakes to:
- provide accurate information about themselves when making an enquiry and not to provide personal data of third parties without their consent;
- not take actions that disrupt the Website, including unauthorised access attempts, DDoS attacks, automated data collection (scraping) and distribution of malware;
- not send advertising, spam or materials violating the laws of the Republic of Kazakhstan via the enquiry form or to the Administration's e-mail addresses;
- respect the intellectual property rights of the Administration and third parties.
4.3.The Administration may:
- change, add or remove Content and Website features;
- restrict access to the Website for a User who violates the Terms;
- not respond to enquiries containing insults or spam or unrelated to the Company's business.
4.4.The Administration undertakes to process Users' personal data in accordance with the Privacy Policy and the laws of the Republic of Kazakhstan.
5. Intellectual property
5.1.Exclusive rights to the Content, Website design, the Urban Media trademark and logo belong to the Administration unless stated otherwise and are protected by the Law of the Republic of Kazakhstan "On Copyright and Related Rights", the Law of the Republic of Kazakhstan "On Trademarks, Service Marks, Geographical Indications and Appellations of Origin" and the Civil Code of the Republic of Kazakhstan.
5.2.Logos, trademarks and names of clients and partners shown on the Website belong to their respective owners and are used solely to inform about the Company's experience. Their display does not grant the User any rights to them.
5.3.Any copying, reproduction, distribution, adaptation or other use of the Content, except as provided in clause 4.1 of the Terms and by law (including quotation with attribution and an active link to the Website), requires the Administration's written consent.
6. Limitation of liability
6.1.The Administration makes reasonable efforts to keep the information on the Website up to date and accurate, but does not guarantee the absence of inaccuracies and is not liable for decisions made by the User solely on the basis of Website information.
6.2.The Administration does not guarantee uninterrupted and error-free operation of the Website and is not liable for temporary unavailability caused by technical reasons, actions of third parties or force majeure.
6.3.The Administration is not liable for losses incurred by the User in connection with the use or inability to use the Website, except as expressly provided by the laws of the Republic of Kazakhstan.
6.4.The User is responsible for the accuracy of the information they provide and for violating the Terms in accordance with the laws of the Republic of Kazakhstan.
7. Links to third-party resources
7.1.The Website may contain links to third-party resources.
7.2.The Administration does not control third-party resources and is not responsible for their content, operation or personal data processing. Use of third-party resources is governed by their own rules.
8. Personal data
8.1.The collection, processing and protection of Users' personal data are governed by the Privacy Policy published at https://urbanmedia.kz/en/privacy-policy/, which forms an integral part of the Terms.
8.2.By completing the enquiry form or providing information about themselves to the Administration, the User consents to the collection and processing of their personal data for the purposes and on the terms set out in the Privacy Policy.
9. Governing law and disputes
9.1.The Terms are governed by and construed in accordance with the laws of the Republic of Kazakhstan.
9.2.The parties seek to resolve disputes through negotiation. Claims are sent to the Administration at info@urbanmedia.kz or to the postal address in section 10; a claim is considered within 30 (thirty) calendar days of receipt.
9.3.If no agreement is reached, the dispute is referred to the court at the Administration's location (Almaty), unless otherwise required by the laws of the Republic of Kazakhstan.
10. Final provisions
10.1.If a court finds any provision of the Terms invalid, the remaining provisions remain in force.
10.2.The Administration's failure to act on a User's breach of the Terms does not deprive it of the right to protect its interests later.
